Local Companies Fined For Failure To Submit Income Tax Returns

​In the months of June, July and August 2022, eighteen (18) local companies were ordered to settle fines at the Magistrate’s Court for failing to comply with Section 52(1) of Income Tax Act (Chapter 35).

Seventeen (17) companies, as listed below, pleaded guilty at the Magistrate’s Court for failing to submit Income Tax Returns for the respective Financial Year ended as follows: 

  • Manzian dan Anak-Anak Sdn Bhd – fined BND5,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2016, 2017, 2018, 2019 and 2020. 
  • Khan Carpet Sdn Bhd – fined BND5,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2016, 2017, 2018, 2019 and 2020. 
  • Kemajuan Pertanian Malar Hijau Sdn Bhd – fined BND5,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2016, 2017, 2018, 2019 and 2020. 
  • Qamar Sdn Bhd – fined BND5,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2016, 2017, 2018, 2019 and 2020. 
  • Hi Rope Engineering (B) Sdn Bhd – fined BND4,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2017, 2018, 2019 and 2020. 
  • Seri Akshaya Contractor Sdn Bhd – fined BND4,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2017, 2018, 2019 and 2020. 
  • Admax Brothers Sdn Bhd – fined BND3,600 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2018, 2019 and 2020. 
  • Momin Engineering Services Sdn Bhd – fined BND3,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2018, 2019 and 2020. 
  • Arsalan Jaya Sdn Bhd – fined BND3,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2018, 2019 and 2020. 
  • Syams & Rully Sdn Bhd – fined BND3,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2018, 2019 and 2020. 
  • Joun BRN Tour Sdn Bhd – fined BND2,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2019 and 2020. 
  • Northstar Petroleum Corporation Sdn Bhd – fined BND2,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2019 and 2020. 
  • JRA Barakah Sdn Bhd – fined BND2,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2019 and 2020. 
  • Kartis & Sons Sdn Bhd – fined BND2,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2019 and 2020. 
  • M.E Real Estate Sdn Bhd – fined BND1,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2020. 
  • Hadson International University Sdn Bhd – fined BND1,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2020. 
  • Tanawal Sdn Bhd – fined BND1,000 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2020. 


Mass Kamal Sdn Bhd was found guilty by the Magistrate’s Court and fined BND7,500 for failing to submit Income Tax Returns for the Financial Years ending on 31 December 2016, 2017, 2018, 2019 and 2020. 

Revenue Division, Ministry of Finance and Economy would like to remind that companies registered under the Companies Act, Chapter 39 are required to submit their Income Tax Returns latest by 30th June of the relevant Year of Assessment. If companies are found guilty for failing to submit income Tax Returns, along with settling the fines imposed by the Courts, they are still required to submit their outstanding Income Tax Returns and pay outstanding Tax amount with penalties which is imposed at maximum 17% of the outstanding tax.
